Your privacy is important, so FanActivate has created the following Privacy Policy to let you know what information we collect, why we collect it, and how it is used.

FanActivate offers a variety of services that are collectively referred to as the “Service.”  FanActivate collects information from individuals who visit FanActivate’s Internet website, fanactivate.com, (“independent advertisers”) and individuals who register to use the Service (“customers”).

The terms "we," "us," and "our" refer to FanActivate. The term “Site” refers to fanactivate.com.  This Privacy Policy is governed by our Terms of Use. By visiting the Site and/or registering to use the Service, you consent to the data practices described in this statement. We may periodically make changes to this Privacy Policy that we will include on this page. It is your responsibility to review this Privacy Policy frequently and remain informed about any changes to it, so we encourage you to visit this page often.

Information That FanActivate Collects

FanActivate collects and stores personal information. Personal information means personally identifiable information, such as names, mailing addresses, phone number, email addresses, credit data, and other financial information.

FanActivate also collects and stores non-personal information. Non-personal information includes browser types, internet service providers and their location, the URLs of previous websites visited, operating systems, IP addresses, and the like.

How and When FanActivate Collects Information

FanActivate may collect and store any information, including personal information, provided to us by prospective and registered independent advertisers in any communication with FanActivate. FanActivate also collects personal information provided by customers in connection with a request to register for the Service. As discussed below, FanActivate uses analytic and reporting technologies to record non-personal information. FanActivate may also use cookies to collect non-personal information.

How do we use this information?

FanActivate primarily uses your personal information for administering the Service and providing service and support to independent advertisers and to customers.  For example, if a customer signs up to receive messages relating to an independent advertiser’s promotional campaign, FanActivate may use the cellular phone number, email address, and/or social media contact information the customer provided to us to send the customer relevant campaign messages.  As another example, if an independent advertiser requires help with the FanActivate Services, a FanActivate employee may ask independent advertiser to confirm personal information, such as the independent advertiser’s name, address, or other relevant identifying information.

FanActivate primarily uses non-personal information to help FanActivate better understand how visitors use the Site and to provide a better experience for our visitors.

Given that the Internet is a global environment, using the Internet to collect and process personal information frequently involves the transmission of data on an international basis. By providing FanActivate with your personal information, you acknowledge and agree that FanActivate may store your personal information and transfer it to and from our servers located in the United States and throughout the world.

What are cookies and how does FanActivate use them?

Cookies help track a person's "session" while online. By showing how and when our visitors use this Site, this information can help us to continue to improve our Site. We will only use cookies to view information on your hard drive that was put there by a cookie from this Site. The use of cookies is an industry standard and many web sites use them. Cookies are stored on your computer and not on this Site. If you do not wish to receive cookies, or want to be notified of when they are placed, you may set your web browser to do so, if your browser permits.

Is Personal Information Shared or Disclosed?

FanActivate is not in the business of selling personal information. We consider this information to be a vital part of our relationship with independent advertisers and customers.  There are, however, certain circumstances in which we may share personal and non-personal information with certain third parties without further notice, as set forth below:

  • FanActivate will disclose non-personal information, in aggregate form, to potential strategic partners, advertisers, investors, customers, and others. You may not opt-out of the sharing of this information. However, it cannot be easily used to identify you personally.
  • FanActivate reserves the right to disclose information, including personal information, to third party governmental agencies or third parties in order to comply with applicable laws, regulations, legal processes or governmental requests (such as in order to comply with a subpoena or court order), to protect FanActivate’s rights, or to prevent, protect against, or investigate illegal activity such as credit fraud. For example, if an independent advertiser submits an advertisement to FanActivate, FanActivate may disclose the independent advertiser’s information to a third party that alleges that the independent advertiser has infringed the third party’s intellectual property rights. Similarly, if a third party alleges that an independent advertiser is infringing upon the third party’s intellectual property rights, we may disclose the third party’s information to that independent advertiser.
  • FanActivate contracts with several partners to help manage, monitor, and optimize FanActivate’s business. For example, FanActivate uses a third party to process credit card payments. FanActivate may also subcontract out analytics, reporting, and/or other operations. Accordingly, FanActivate may need to share personal information with these partners so that the partners can provide the services in question. FanActivate will use commercially reasonable efforts to prevent such partners from disclosing your personal information, except for the purpose of providing the services in question. FanActivate cannot guarantee that such partners will not disclose your personal information.
  • FanActivate also uses third party vendors to display relevant ads for FanActivate at locations away from the Site on the Internet. These vendors may collect anonymous information about your visits to the Site, and your interaction with our products and services. These vendors may also use information about your visits to this and other websites to target advertisements for goods and services. Some of these vendors use cookies and/or web beacons to collect anonymous information and to display ads based on your previous visits to the FanActivate site. You can opt out of interest-based advertising by visiting the Network Advertising Initiative opt-out page.
  • In the event FanActivate goes through a business transition, such as a merger, acquisition, or sale, your personal information will likely be among the assets transferred to a successor-in-interest. FanActivate reserves the right to transfer any personal and non-personal information to such successor-in-interest.
Security

FanActivate endeavors to protect all personal Information collected through Site in a safe, confidential, and secure manner.  To this end, FanActivate uses Secure Sockets Layer (SSL), an advanced security protocol that protects your credit card information and promotes secure online ordering. SSL Internet connections are encrypted, and may protect credit card ordering information, including your name, address, and credit card number, so it cannot be read in transit.

FanActivate also uses secure technology, privacy protection controls, and restrictions on employee access to safeguard personal information.  FanActivate will hold any personal information sent to us securely in accordance with our internal security policy and the law.  For example, customer information is securely stored on FanActivate’s list server that delivers the campaign messages.  The customer information can only be accessed by FanActivate employees who help manage the lists in order to deliver messages to customers who have registered for the FanActivate Service.  FanActivate will at no time collect or redistribute your personal information without your consent, except as detailed in this Policy.

Links to Other Sites

The FanActivate Site and independent advertisers’ campaign messages administered by FanActivate may contain links to websites controlled by independent advertisers and other third parties.  FanActivate provides these links merely as a convenience and FanActivate is not responsible for and does not endorse, adopt, agree with, or accept any responsibility over the contents or use of these websites. Access to other websites is at your own risk and FanActivate expressly disclaims any responsibility for the content of any third party sites linked to this site. You should take precautions to ensure that whatever you select for your use is free from viruses, worms, trojan horses and the like. You should also refer to the policies posted by the other websites regarding privacy and other topics before you use them. FanActivate is not responsible for third party content accessible through the Site, including opinions, advice, statements, and advertisements, and you assume all risks associated with your use of this content. If you choose to purchase products or services from a third party, your relationship is directly with the third party. FanActivate makes no representation or warranty as to any third-party products or services.  Accordingly, FanActivate encourages you to be aware when you leave the Site and to read the terms and conditions and privacy policy of each other website that you visit.

Children’s Privacy

The Site and the FanActivate Service is intended for adults. FanActivate does not knowingly collect personal information from children under the age of 13. Nevertheless, if the parent or guardian of a child under 13 believes that the child has provided us with personal information, the parent or guardian of that child should contact us if they want this information deleted from our files so that it is not in retrievable form. If FanActivate otherwise obtains knowledge that FanActivate has personal information about a child under 13 in retrievable form in our files, FanActivate will delete that information from our existing files so that it is not retrievable.

Reviewing and Making Changes to Personal Information

You can obtain a copy of and request that we correct errors in your personal information by contacting us. For your protection, you will be required to provide proof of your identity to obtain a copy of your personal information. If your personal information changes or if you no longer want to use the FanActivate Services, you may correct, update, or deactivate your personal information and/or your account by contacting us.

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by FanActivate to third parties for the third parties’ direct marketing purposes. Opting Out of Communications from FanActivate

FanActivate wants to communicate with you only if you want to hear from us. All electronic communications that are sent to you by the FanActivate Service include an unsubscribe link in them. If, for any reason, you would no longer like to receive electronic communications from FanActivate, you can unsubscribe by clicking the unsubscribe link.  You can also contact us at support@fanactivate.com to change your information at any time.  Please note that, if you decide not to receive marketing emails from FanActivate, you may still receive “transactional” email messages (i.e. registration confirmation, customer service notifications, etc.). Your Consent To This Privacy Policy

By using FanActivate, you agree to this Privacy Policy. This is our entire and exclusive Privacy Policy and it supersedes any earlier version. Our Terms of Use take precedence over any conflicting Privacy Policy provision. We may change this Privacy Policy at any time at our discretion by posting a new version of this Privacy Policy on the Site, which it is your responsibility to review. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the personal information we collect. Your continued use of the Site or the FanActivate Service constitutes your agreement to this Privacy Policy and any updates.

Legal Disclaimer and Waiver of Liability

FanActivate operates "AS-IS" and "AS-AVAILABLE," without liability of any kind. FanActivate is not responsible for events beyond our direct control.
Whenever we obtain your personal information, we use commercially reasonable efforts to protect it from unauthorized access or disclosure. Nevertheless, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. Accordingly, FanActivate assumes no liability for any disclosure of data due to errors in transmission, unauthorized third party access, or other acts of third parties, or acts or omissions beyond our reasonable control.

The content that you store, post, or transmit on or through the Site may be accessed by other users, including people that you do not know. We are not responsible for the actions of others. Therefore, you should use care in communicating with other users and only disclose your personal information to other users that you know to be trustworthy. You should not assume that your content will be kept private.
